These Terms of Use govern your use of Best Birth Finder and provide information about the Best Birth Finder service.  When you submit a review, you agree to these terms.

Best Birth Finder is a product developed by Maternity Choices Australia.  These terms therefore constitute an agreement between you and Maternity Choices Australia.

The Best Birth Finder Service

​

We agree to provide you with the Best Birth Finder (BBF) Service as follows:

​

• ability to submit reviews of Australian birth services (NOT individual clinicians) you have used at any time

• ability to search reviews submitted to BBF

• copy of all data review submitted to BBF, and draft feedback email for your birth service, sent to your email account

​

Births in hospital, or at home (or elsewhere) and with or without a registered birth attendant can be entered into BBF.

Data submitted to BBF is stored and protected according to our Privacy Policy.  Most importantly, names and email addresses are not published with reviews submitted.

​

BBF does NOT provide reviews of birth clinicians' services.  We explicitly ask that our reviewers DO NOT include clinicians' names.  We will check each submitted review to ensure clinician names are not included before we publish the review.  If a clinician's name is entered in a review, we will remove any identifying information, such as the clinician's name, with "XXX" before we publish.  As we are volunteers, this process generally takes 24-48 hours.

Limits on Liability

BBF does not verify any of the data in reviews, therefore MCA cannot confirm the accuracy of reviews submitted to BBF.  MCA bears no responsibility for decisions you may make in opting for a particular birth service based on a review you may have read on BBF.

Your Commitments

​

In return for providing this Service, we require you to make the following commitments to us.

​

The data you enter:

• is based on true events that happened to you in a birth service in Australia

• does NOT contain individual clinician names, or advertisements for services/products

• does not contain vexatious content, but is shared in the spirit of helping other women finding their best birth service

You treat the reviews you read as unverified and therefore requiring further independent research before you make your final decision.  BBF is intended as an initial starting point only for researching your best birth service.

Permissions you Grant us

​

As part of our agreement, you also give us permissions that we need to provide the Service.

 

We do not claim ownership of your content, but you grant us a licence to use it.  We do not claim ownership of your data that you submit through the Service. However, by using the Service you agree to MCA using your data (anonymised, ie without your name and email address linked to it), collated with all other submitted data, for internal analysis that we may publish elsewhere (such as on social media) or in submissions to government in our advocacy for improved maternity services. This permission will end when your content is deleted from our systems.

 

You can ask us to delete your review by emailing us at bbf-at-maternitychoices.org.au.

Accepting the Terms

By using this Service to submit or search birth service reviews, you are accepting these Terms.

​

Governing Law

​

We want you to enjoy using BBF, so if you have an issue with BBF you agree to raise it with us and try to resolve it informally. You can contact us with any feedback or concerns at bbf-at-maternitychoices.org.au.  Any claims arising out of using this Service or these Terms will be governed by the laws of New South Wales, Australia.

Your Licence to Use this Service

​

MCA grants you the personal, free licence to use this Service for the purposes described above.

​

BBF is protected by copyright and other laws of both Australia and foreign countries.  Nothing in these Terms gives you the right to use the BBF name or distinctive brand features.  All right, title and interest to and in BBF (excluding content provided by users) are and will remain the exclusive property of MCA.  Any feedback, comments and suggestions provided by you to MCA regarding BBF is entirely voluntary and we will be free to use such feedback, comments and suggestions as we see fit and without obligation to you.
